California compliance
California insurance fraud training
California requires admitted insurers to run a full anti-fraud training program: an orientation for new employees within 90 days, annual in-service training for claims, underwriting and legal staff, and at least five hours a year for SIU personnel.
The requirement
What California requires
Insurance Code 1875.20 through 1875.24 require every admitted insurer to keep a special investigative unit. The SIU regulations, Cal. Code Regs. title 10, sections 2698.30 to 2698.42, set the training rules in section 2698.39.
Newly hired employees must receive an anti-fraud orientation within 90 days of starting their duties, covering the SIU's function, fraud detection and referral, Fraud Division reporting requirements and SIU contacts. Integral anti-fraud personnel, meaning staff outside the SIU whose duties involve claim or application decisions, such as claims handlers, underwriters and legal staff, must receive annual in-service training on referral procedures, red flags, reporting and emerging fraud trends. SIU personnel must complete at least five hours of continuing anti-fraud training each calendar year.
Insurers must keep detailed training records, including title, date, instructor, materials, length and each participant's name and job title, give them to the Department of Insurance on request, and describe their training in the annual SIU report. The Department audits training compliance.
